Step by step
- Check jurisdiction. Decide which district to give notice in, based on where each of you actually lives.
- Notice of intended marriage. Submit notice with documents to the Marriage Officer.
- Publication and objections. The notice is kept open for 30 days. Objections can only be on the legal conditions in section 4, such as age or an existing spouse.
- Solemnisation. Appear with three witnesses and sign declarations before the Marriage Officer, within three months of the notice.
- Certificate. The marriage is entered in the Marriage Certificate Book and a certificate is issued.
Delhi vs UP vs Haryana
The Special Marriage Act is a central law, so its conditions are the same everywhere. Uttar Pradesh and Haryana also have anti-conversion laws, which matter if either partner is considering conversion. Under the Special Marriage Act, no conversion is involved. See court marriage across Delhi NCR.
Objections and threats
An objection does not stop the marriage unless it shows a legal bar. If you face threats, the police and courts can provide protection; the Supreme Court has repeatedly affirmed adults' right to choose their partner.
Other legal routes
Some couples consider marriage under one partner's personal law after conversion. That has consequences for succession, and in UP and Haryana conversion requires prior declarations. See Hindu–Muslim, Hindu–Christian and Hindu–Sikh marriage.
