Documents for Inter-Religion Marriage Under the Special Marriage Act

Most inter-religion couples marry under the Special Marriage Act so that neither partner has to convert. The documents are the same as any civil marriage, with a few points that come up often.

Core documents

  • Age proof for both partners.
  • Identity proof (Aadhaar, passport or voter ID).
  • Residence proof showing at least one partner has lived 30 days in the district.
  • Passport-size photographs.
  • Affidavits on date of birth, marital status and that the parties are not within prohibited degrees.
  • Three witnesses with identity and address proof.

Document requirements may vary depending on the applicable legal route, individual circumstances and the concerned authority.

Additional documents in some cases

  • Divorce decree (and proof it is final) or death certificate of a former spouse.
  • For an NRI or foreign partner: passport, visa, and a single-status or no-impediment certificate, often attested or apostilled.
  • Name-change gazette or affidavit if names differ across documents.

What is not required

  • Religion certificate or conversion documents.
  • Parental consent or parents' documents (for adults).
  • Approval from any religious body.
